It’s time to go back to school with the Top 5 Court of Appeal decisions from July and August, as selected by this month’s Netletter author, Bryan Smith.
These decisions deal with the occupier’s liability analysis applicable to a physical assault during a soccer match, variation of a judgment for constructive dismissal including punitive damages, whether an insured gets to keep an overpayment by their insurer, a child access order based on the parties’ competing religious beliefs, and the class counsel fee and costs relating to a class action.
