Romanic v. Johnson
Posted March 4, 20162013 ONCA 23; Lerners acted on behalf of the Respondent, Niagara Regional Police Services Board and various officers, in this appeal from a summary judgment motion dismissing the Appellant’s action. The Appellant was a former police officer who resigned his employment as part of a plea bargain to avoid criminal prosecution. He subsequently sued the Respondents for malicious prosecution and negligent investigation. On January 13, 2013 the Court of Appeal confirmed the motion judge’s determination that the Appellant was precluded from proceeding with his action because the criminal proceedings on which the alleged torts were based had not been terminated in his favour.
