Durling et al v. Sunrise Propane Energy Group Inc. et al

Lerners is acting in defence of third party claims related to the class proceedings brought as a result of the well-publicized Sunrise Propane explosion in Toronto. A class action has been brought on behalf of residents, businesses and institutions who were affected by a series of explosions in the early morning hours of August 10, 2008. The defendants include the operator of the propane facility at the site, the owner of the lands, manufacturers and suppliers of the components implicated in the explosions, and the Technical Standards and Safety Authority; some of those defendants have commenced further proceedings against other component suppliers, including Lerners’ client. The court is considering whether to certify the action as a class proceeding, and if so, on what terms.
