Caputo v. Imperial Tobacco Ltd. et al.

The plaintiffs sought to certify a class action against the three major tobacco manufacturers, claiming damages for personal injuries suffered by Ontario smokers and their families. They alleged that the manufacturers designed and produced inherently defective and dangerous products and marketed them with the knowledge that they were addictive and harmful. However, the plaintiffs’ motion for certification was dismissed.
