Posted June 27, 20192019 ONCA 354 – After Catalyst lost a bid to purchase Wind Mobile, it commenced an action against the winning bidders and others seeking over $1 billion in damages. The respondents successfully brought a motion to have the action dismissed as an abuse of process, and the Court of Appeal dismissed Catalyst’s appeal. Lerners represented one of the respondents.
