Commercial Arbitrations
Arbitrations provide an opportunity for parties to resolve their disputes in a cost-effective and confidential manner, without resorting to the traditional judicial system. At the heart of arbitration practice is the notion of party autonomy. Commercial clients can choose the rules of arbitration and, importantly, the person or persons who will hear their dispute. This model is supported by the Ontario courts; arbitral awards are enforceable with minimal judicial intervention and review in Ontario and are enforceable internationally far more readily than judicial awards. The commercial litigation group at Lerners includes both experienced arbitration counsel and arbitrators. We can assist our clients in drafting arbitration clauses for insertion in their commercial contracts, suitable to the nature of the contract itself and the range of disputes that could arise under it. Should a dispute arise, we can help our clients achieve an optimal result through the arbitration process.
