  • Acting for a short seller who was one of a number of defendants sued by a private equity fund for defamation arising from an article in the Wall Street Journal. The action was dismissed as a strategic lawsuit against public participation (SLAPP).

  • Acting for an applicant in proceedings to enforce judgments of a United States court in Ontario relating to a property in Ontario, including the appointment of a receiver to take possession of and to sell the property.

  • Acting for a shareholder in a closely-held company in which the value of her equity interest was diluted as a result of the actions of the controlling shareholder. The court determined that the controlling shareholder’s actions were oppressive and set aside the impugned transactions.

  • Acting in a confidential arbitration involving a dispute between three shareholders of a family-owned company in which one shareholder alleged that the other two shareholders were acting in an oppressive manner. The arbitrator found in favour of Lerners’ clients.

  • Acting for the manager of a closed-end investment trust that was sued by a unitholder for entering into a transaction that had the effect of diluting the net asset value per unit of certain unitholders. The action was dismissed by the trial judge.

  • Acting for a large group of plaintiffs in an action in Ontario for the recognition and enforcement of a judgment of the United States District Court against the Islamic Republic of Iran and the Islamic Revolutionary Guard Corps for providing material support to a group that was responsible for a terrorist attack on the living quarters of members of the US armed forces in Saudi Arabia in 1996. The plaintiffs are victims or family members of victims of that attack.

  • Acting for an individual in a statutory appeal of a decision of the Registrar under the Indian Act to deny her status under the Indian Act on the basis that her grandfather withdrew from treaty and took scrip in the 1880s.

  • Acting for a credit union in a statutory appeal of a decision by the provincial regulator to appoint an administrator to manage the operations and affairs of the credit union.

  • Regularly acting for domestic and foreign companies in contract and commercial leasing disputes.
