- Crete v. Ottawa Community Housing Corporation, 2024 ONCA 459 – successfully argued an appeal at the Court of Appeal for Ontario on behalf of a social housing provider. At issue was whether a lease agreement was in non-compliance with the Residential Tenancies Act (“RTA”) for delegating winter maintenance responsibilities of the leased premises to a tenant. The Court of Appeal upheld that provision was not void under the RTA given that the areas delegated to the tenant were under their exclusive use. This decision will have significant implications on residential tenancy agreements in Ontario as well as liability determinations in personal injury slip and fall cases on leased property.
