This month we express our most heartfelt congratulations to our friend and colleague, Jasmine Akbarali, on her recent appointment as a Judge of the Ontario Superior Court of Justice. She will be greatly missed.
She did however leave us with another Lerners win for this month's top 5, in a case which considered the duty of care owed by an auto garage to teenagers who stole a car for a joyride. Rounding out the top 5 are decisions dealing with the validity of a municipal by-law addressing the placement of “community mailboxes”, motions to stay actions under the Arbitration Act and the arbitration clause in a sales agreement, respectively, and a motion for partial summary judgment in an action arising from the purchase of units in the Trump International Hotel.
