We are now two thirds of the way through Q1. Apparently time slows down not only as you approach the speed of light, but also during the worst winter in recent memory.
The wheels of justice may also turn slowly, but they never stop and January was no exception at the Court of Appeal. The Top 5 decisions selected by this month’s Netletter authors, Yola Ventresca and Alex Sharpe, deal with a disputed exercise of a right of first refusal on a sale of property, an application for Charter damages in a case of extended detention prior to deportation, the limitation period applicable to a claim for an allegedly improvident sale of property (affirming the decision of our former colleague, Akbarali J.), a refusal to validate late service of a Statement of Claim, and jurisdiction over claims brought in Ontario pertaining to business dealings in the United States.
