Top 5 Civil Appeals and the Top 5 All Time Sports Collapses

This month we are proud to announce that our friend and partner, Kirk Boggs, has been selected as this year’s recipient of the OBA Award for Excellence in Insurance Law. This award recognizes outstanding lawyers for their exceptional achievement in Insurance Law, for maintaining the highest levels of professional competence, and for their enhancement of the profession of law and contribution to their communities. Turning to the Top 5 (technically Top 6) Court of Appeal decisions from April, as selected by this month’s Netletter author, Mark Freiman, these deal with the duty of care analysis in a class action arising from the supply of potentially tainted meat to restaurant franchisees, the interpretation of an exclusion in a title insurance policy with respect to mortgage fraud, the alleged vicarious liability of a law firm for allegedly defamatory correspondence sent on its letterhead by a lawyer practicing “in association” with the firm, the dismissal of a defamation claim against the Better Business Bureau arising from ratings posted on its website, and court jurisdiction over child custody and access.

Mark also brings you his Top 5 All Time Sports Collapses, in which – as sometimes happens on appeal – defeat has been snatched from the jaws of victory.
