Noteworthy Cases
Jerry v. The Corporation of the City of Barrie et al., 2020 ONSC 629: Acted with senior counsel, Jennifer Hunter, as trial counsel for the successful defendants, the City of Barrie and several city officials. This claim arose out of the plaintiffs’ allegations that the defendants had prevented a cellular communications tower from being installed on the plaintiffs’ property. The plaintiffs sought damages under the torts of misfeasance in public office and intentional and unlawful interference with economic relations. The defendants were entirely successful at trial with the plaintiffs failing to prove liability, causation or damages.
Tahir v. Mitoff, 2019 ONSC 7298: Acted with senior counsel, Anne Spafford and Cynthia Kuehl, as trial counsel on behalf of the successful defendant physicians in a medical malpractice claim. The claim was dismissed as the defendants were all found to have met the standard of care.

Justin Martin is a Toronto-based partner at Lerners whose litigation practice focuses on health law and insurance defence.
“I assist health professionals — primarily physicians — in litigation and regulatory proceedings, be they lawsuits, complaints, or investigations,” explains Justin. “I also advise on issues relating to patient management and privacy concerns.
“In my specialty risk and insurance practice, I defend insured entities, including municipalities, police services, children’s aid societies, and individuals on a wide range of matters. This includes actions relating to personal injury, motor vehicle accidents, occupier liability, slip and falls, and property damage.”
Representing several police services, Justin acts for police officers in malicious prosecution and negligent investigation proceedings. He also defends municipalities in matters relating to issues such as the design of highways and roads, building inspection and acts for municipal employees who are targeted for the execution of their duties.
A hardworking but reasonable advocate, Justin will defend his client’s interests to the best of his ability. However, he also considers himself a collaborative lawyer, and he will consider his client’s input carefully when strategizing. “I will always be a strong advocate for my clients. However, I also believe it is important to be frank and candid with my clients. If we have serious issues with our case, my client needs to know and consider this when giving instructions.”
