Posted March 4, 2016Lerners acts for the Appellant in this appeal of a dismissal on summary judgment. The motion judge interpreted termination provisions in a business agreement between the parties, regarding compensation for collection work completed at the time of termination, and found that the Appellant could not invoice for services performed up to the date of termination unless it was in possession of a file when a debtor payment was made. Accordingly, the motion judge dismissed the Appellant’s action. The Appellant appeals the interpretation of the agreement and the dismissal of its action (Court of Appeal, April 13, 2015).
