Posted March 4, 20162014 ONCA 923; Lerners acted for the respondent in this appeal of a dismissal on summary judgment. This action arose from a hip replacement surgery, after which the appellant allegedly suffered dislocations and commenced this action against several medical professionals involved in the surgery and the hospital. The Court of Appeal upheld the motion judge’s dismissal of the action, noting that serving “any expert report” was insufficient for the plaintiff to resist summary judgment where the plaintiff’s report did not contain evidence on the essential elements of causation or breach of standard of care.
