Registrar of Alcohol, Gaming and Racing v. Aspden
Posted October 24, 20192019 ONSC 1940; Lerners represented licensed race-horse owners in an application for judicial review of two decisions of the Horse Racing Appeal Panel (“HRAP”) commenced by the Registrar of Alcohol, Gaming and Racing (“Registrar”). In this case, Lerners successfully argued that the HRAP had jurisdiction to confirm the disqualification of a competitor race-horse that tested positive for a prohibited substance, and properly awarded costs in Lerners’ clients’ favour. The Registrar’s application for judicial review was dismissed.
