Jeffery v. London Life Insurance Company
Posted March 4, 20162014 ONCA 87 (CanLII); Lerners represented the responding plaintiff class in this appeal concerning the proper quantum of damages in a successful class action. The class action stemmed from the amalgamation of two insurance companies. The Ontario Court of Appeal allowed the appeal and substituted a different quantum of damages, holding that the trial judge did not properly interpret a number of damages formulas set out in the Court’s prior decision in these proceedings.
