Groia v. Law Society of Upper Canada
Posted April 20, 20162016 ONCA 471 (CanLII); Lerners acted for the appellant in this appeal of a Law Society Appeal Panel finding of professional misconduct during a trial. A majority of the Court of Appeal dismissed the appeal, finding that the Appeal Panel had formulated a reasonable test for incivility and that the finding of professional misconduct was reasonable. However, in a strong dissent, Brown J.A. would have allowed the appeal. The appellant has been granted leave to appeal to the Supreme Court of Canada.
