2014 ONCA 671; Lerners acted for the appellants (respondent in the motion) in this appeal of a motion for dismissal. The case arose out of engine malfunctions in a yacht purchased by the appellants, which was sold and manufactured by the respondents, respectively. The motion judge dismissed the action for delay. The Court of Appeal held that the motion judge property exercised his jurisdiction to dismiss the claim and dismissed the appeal
