Charter challenge of provisions of the Canada Pension Plan; Canadian Charter of Rights and Freedoms
Posted March 5, 2016Represented the appellant before the Federal Court of Appeal, in this constitutional challenge arguing that the combined operation of the proration and disability provisions in the Canada Pension Plan (CPP) had a discriminatory effect on women, particularly working mothers. The appellant appealed a decision of the Pension Appeals Board, arguing that the impugned provisions in the CPP unjustifiably infringed the equality guarantee in the Canadian Charter of Rights and Freedoms.
