Astley v. Verdun
Posted March 28, 20162014 ONCA 668; Lerners acted for the respondent (plaintiff in the action) in this appeal. At the trial of the action, the appellant was found guilty of defamation and subsequently was made subject of a permanent injunction that, among other things, enjoined him from publishing any statements or communications referring to the respondent. The appellant later forwarded a fax containing reference to the respondent, and on this basis was found guilty of contempt of the permanent injunction. The Court of Appeal dismissed the appellant’s appeal of the contempt finding.
