Lerners represented the Respondent in an appeal of a dismissal order. The action arises out of an incident during which the Respondent allegedly assaulted the Appellant. The motion judge dismissed the Appellant’s action on the basis of noncompliance with an earlier pre-trial order. The Appellant appealed the dismissal of his action. The appeal was successfully defended with the Court of Appeal dismissing the appeal (2015 ONCA 164).
