C.A.); In this case, the Federal Court of Appeal considered whether the Charter of Rights and Freedoms applies to the detention of non-Canadians by Canadian Forces in Afghanistan, or to the transfer of those individuals to Afghan authorities, particularly where torture is reasonably anticipated.
