2012 ONCA 544 (CanLII); Lerners acted for the appellant in this appeal of a judge’s decision to dismiss the plaintiff’s action for delay at a status hearing. The Court of Appeal for Ontario dismissed the appeal and refused to re-instate the action, based on, among others, the fact that more than 5 years had elapsed since the beginning of the action and that no action was taken by the plaintiff to move the action along.
