Municipalities do not owe duty of care to negligent drivers: OCA
A municipality’s duty of care with respect to maintenance of roads does not extend to negligent drivers, the Ontario Court of Appeal has ruled in a new leading decision that’s poised to change how liability is assessed in future cases, says Toronto insurance defence lawyer Jennifer Hunter.
