When determining whether a driver had consent to have possession of a vehicle, a court is likely to consider factors such as the driver’s prior use of the vehicle; whether the driver was previously reprimanded for breaking rules related to use of the vehicle; and the driver’s access to the vehicle, Toronto insurance defence lawyer Jennifer Hunter writes in Lawyers Weekly.
