For those of us in Toronto, April brings not only the promise of better weather, a promise not yet rewarded, but also the hope that this year might be different. The Raptors are in the playoffs and trying to get past the first round. Meanwhile, the Blue Jays have started the season as one of the favourites. As a Torontonian, I know my hopes will be crushed, but it feels good while it lasts.
Conversely, the Court of Appeal can always be depended upon to release important, interesting decisions. This month's netletter summarizes appeal decisions with respect to the limitation period for a continuing breach of contract, the application of estoppel in a will challenge, when an unequivocal bequest in a will can be contrary to public policy, limitation periods in actions against lawyers and how an accident is defined in the Statutory Accident Benefits Schedule.
