2013 ONCA 247 (CanLII); Lerners acted for the respondent in an appeal from a summary judgment motion dismissing the appellant’s claim due to failure to abide by the ten day notice period under s.44(10) of the Municipal Act, 2001. The Court of Appeal for Ontario upheld the motion judge’s dismissal of the action, agreeing that the appellant failed to establish a reasonable excuse for the delayed notice.
