2014 ONCA 333 (CanLII); Lerners acted for the responding defendant in this appeal of a successful summary judgment motion. The plaintiff claimed interest in a water supply line easement. The Ontario Court of Appeal allowed the appeal and set aside the dismissal of the action, holding that there was evidence to suggest that the easement had in fact been conferred to the plaintiffs, and as such there was a genuine issue requiring trial.
