Lerners LLP represented Allianz, AXA, Middlesex Mutual, The Personal, Pilot, Trafalgar, and Royal & SunAlliance insurance companies, in the successful defence of seven similar class proceedings, (including a requested defence class proceeding targeting all Canadian automobile insurers not individually sued), alleging improper appropriation of damaged vehicles after the insurers’ payment of the vehicles actual cash value less a deductible. Intended national class actions, alleging millions of dollars of damages, by thousands of insureds. Actions all dismissed at first instance, prior to subsequent Court of Appeal confirmation that there was no underlying cause of action.
