Insurers must try to settle, but can still go to trial (by Jennifer Hunter)
Written by Jennifer Hunter; There are some very welcome words from the Ontario Court of Appeal in a recent decision regarding an insurer’s statutory obligations to attempt settlement under the Insurance Act, R.S.O. 1990, c I.8. “Insurers, like any other defendant, are entitled to take cases to trial,” the decision said, and in doing so affirmed a fundamental principle that many insurers and defence counsel have argued for years.
