Duty of care for rescuers (by Nigel Gilby and William Simpson)
Jennifer Maguire reacted instinctively: she stopped her car abruptly in the midst of a winter storm and went into a ditch to help free a mother and infant from their overturned van. Three other good Samaritans also stopped to help in the same way that Jennifer did.The mother and child were rescued from their vehicle jointly by the four rescuers. A police officer arrived at the scene. The mother and infant were seated in the back of the police cruiser so as to have shelter from the weather outside. Then tragedy ensued.
